MAX FITNESS CLUB MEMBERSHIP CONTRACT

  1. Contracting Parties

S.C. MAX FITNESS S.R.L., with registered office in Popești-Leordeni, Str. Biruintei no. 49, Ilfov county, Tax ID 43351730, registered with the Trade Register under no. J23/5571/2020, as Service Provider.

  1. Contract Object

The object of this contract is the provision by MAX FITNESS of member access to fitness and bodybuilding services, through subscriptions, for weight training and cardio areas, in exchange for a monthly payment, periodically established by the Provider.

  1. Contract Duration

This contract terminates in the following situations:
Upon expiration of the contractual period;
In case of force majeure;
In case of member’s death;
By effect of law or final court decision;
Through termination by MAX FITNESS, in case of non-compliance with contractual obligations by the member.

  1. Terms and Conditions of Membership Status

Subscriptions are individual, non-transferable and valid exclusively for the holder of this contract.
By signing the contract, the member declares that they have read, understood and fully accepted its content, as well as the internal regulations.
The amount paid for the subscription is non-refundable, except in medically justified cases, based on supporting documentation.
Any waiver of rights provided in the contract is valid only in writing, signed by the renouncing party.
MAX FITNESS reserves the right to periodically modify the contract and regulations, displaying new versions at reception and on online platforms. Changes take effect from the moment of display.
Members are obligated to permanently respect both this contract and the regulations displayed at reception, in the gym and on official pages.

  1. Force Majeure

MAX FITNESS is not responsible for non-performance or improper performance of contractual obligations in case of force majeure or unforeseen events.

  1. Personal Data Protection (GDPR)

By signing the contract, the member expresses their agreement regarding the collection and processing of their personal data by MAX FITNESS, in accordance with EU Regulation 2016/679 (GDPR). Refusal to provide this data leads to the impossibility of concluding the contract. In case of data changes, the member undertakes to notify the Provider in writing.

  1. Disputes

The parties undertake to resolve any dispute amicably. Otherwise, disputes will be resolved by competent courts.
